The writer surnamed Liu but better known by her internet alias Tianyi was handed a 10-and-a-half year jail term for “producing and selling pornographic materials” last month according to a television report on Friday.
Under mainland China’s criminal law many rapists are only liable to serve a jail term of between three to 10 years.
One case cited by critics was that of an official in Yunnan province who was sentenced to five years in prison for abducting and raping a four-year-old girl. Following a public outcry the sentence was increased to eight years.
Another was a man who was sentenced to 6½ years in jail for beating his wife to death in Beijing in 2009.
“It might have been difficult to sell 5000 copies in 1998 – there was no internet back then. But now it is almost effortless” said one of the most liked comments on Weibo.

Title is a bit misleading this has little to do with GAY sex scenes so much as sex scenes in general. Pornography is illegal and the outdated sentencing guideline punishes this case too severely.
But of course still shocking that it's punished more severely than rape or murder.

Sure they can be. But it generally isn't the reality. Full sentencing information on bunch of drivers who raped and murdered girls was made public in very recent memory and the maximum sentence on it was 2 years.
prophecy0091
more severely than murder? you mean murder is less than 10 years?

From the article:
[The heavy sentence imposed in this case ignited an uproar. Outraged social media users were quick to point out that many serious crimes including rape violence and manslaughter carried a lower sentence.]
[Under mainland China’s criminal law many rapists are only liable to serve a jail term of between three to 10 years.]

Maybe that's precisely why they are targeting it. Young people don't realise they have independence and power yet. Drill it into them that the parental rule is absolute despite it not making any sense

maybe but i feel like you'd have to be north korean-level of isolated for that to work. mainland china is definitely culturally isolated - they basically use an entirely different internet from the rest of the world - but they'll still see news of gay marriage being legalized and homosexuality being decriminalized all around the world throughout the coming years. compared to other more nuanced and complicated topics (abortion for example which is at least far more morally ambiguous than gay rights) gay rights is really easy to wrap one's head around.

[And the author made money distributing illegal minor pornography to people]
As in other books or actual child pornography?
shipiaozi
Fictional 17-years gay rape target female audience child pornography isn't that sensitive in China even actual child pornography maker may only sentenced to 1-5 years(not more serious than adult porn). The real problem here is illegal publishing if you dare to publish gay porn today someone would publish anti-communism book tomorrow.
My parents run printing company it is extremely dangerous to print illegal book(not approved by government). Government would ban you from printing and even worker who fix the printing machine would be sent to jail.

Isn't the real problem that you can be jailed for writing an erotic novel...?
CauchyGaussian
Well technically porn is also illegal in China so there you go.
ekfslam
That doesn't seem to be the case when you check online.

It’s totally legal to write that and send it privately.
It’s illegal to publicly spread it and let minors to read it. It will make you detained for several days if you got reported.
It’s felony to sell it. The punishment depends on the amount you sell and earned.

Her family are those typical outdated conservative. they should die in cultural revolution for their old belief that’s too rude lol
Even one of her family member agree she can have lawyer. But everyone want she to be in jail include her younger brother.
rebble_yell
Lots of people have terrible families.
But it's still the government doing this to her.
slow_rick
That is messed up. Thank you for taking the time to report on the situation from a Chinese point of view.

[Same sex is not the issue.]
Right but just because it isn't on paper doesn't mean that this isn't an LGBT rights record and we shouldn't ignore China's poor performance on LGBT rights.

Chinese people lack some fairly basic freedoms those of us in North America and Europe enjoy. This however seems pretty extreme even for China.
vaCew
The cause is that porn is illegal and while the web is full with porn and everyone watches it but you are right this seems an really extreme case even for china from what i know she wasnt really political active either so that cant be reason either. But WeChat full of people complaining allrdy if the outcry on chinese media is bad enough maybe they will reconsider/change her sentence
juche
Good thing she did not actually do it...just wrote about it.
The vendor should be responsible for things like age restrictions and alike and whoever purchased it (unless it was stolen) is ultimately responsible for a 'minor' having access to adult content in such circumstances.
Even lack of such a warning should carry nothing more than a minor penalty and a product recall.
I'm not talking from a "china has different laws" perspective here. I'm saying regardless of if chinese law works this way or not it's pretty clear that this is all pretty fuckin stupid.
