China’s theft of U.S. intellectual property is undercutting small businesses across the country, according to Admiral Dennis Blair, co-chair of The IP Commission.

Blair told FOX Business’ Ashley Webster that a small sprinkler irrigation company in Walla Walla, Washington, Nelson Irrigation Corporation, had its propriety design stolen by a Chinese company.

“They are now selling them back over into the American market, over the internet, using titles like Chinese Nelson,” he said.

President Donald Trump authorized a plan to slap new tariffs worth $50 billion on Chinese goods Thursday, targeting 1,300 items.

The Commission on the Theft of American Intellectual Propertyestimates that the U.S. economic cost from counterfeit goods, pirated software and the theft of trade secrets by China is as high as $600 billion annually.

Blair said China’s intellectual theft was perceived in the past as an “adolescent phase” of a developing economy. However, the world’s second-largest economy has advanced its tactic of intellectual property abuses.

“We face Chinese companies with a choice here, Ashley. Either you steal our property or you can use our market,” he said. “You can’t do both.”

I've worked with hundred of companies here in the US and this is a story I hear all the time.  The company develops a process or a new design and patents it.  The Chinese steal it and it appears on the market in less than 6 months.  It costs money to develop and they can't get a return on that investment.  That impairs innovation. Can't sue them in US courts because the courts don't have jurisdiction  Can't sue them in Chinese court because they don't care and are profiting.

If the Chinese product is violating a US patent it can be blocked from sale in the US. It costs money to go through the process, but that is true of domestic patent violators too.

Seems that the US government has structured the system to make it very difficult to address this issue. Can and does take decades to go through the courts. 
One does have to wonder why the system is set up to benefit China not America?

The Chinese steal software and sell it in their own country. They also steal hardware designs from other countries and produce those items for consumption in their own country without paying any royalties. There is nothing a US  patent court can do to stop it.

China spent two damn years in Department of Defense computer systems, unnoticed.  Didn't hear much about that in order to protect politicians jobs.  China is not our friend.  I expect them to have the dominate currency within 5 years while nailing the fate of US economics.

Hey 500px are you reading this. In Case all you photographers did not know, 500px, a one time photographers haven sold 100% of the Company to a Chinese firm VCG. I immediately removed all my Photographs from the site. When I contacted 500px they said  Oh do not worry. RIGHT, the Chinese, Taiwanese and SE Asia in general has no respect for copyrights and Intellectual Property at all. For all those Photographers on 500px Good Luck. Remove your Photographs IMMEDIATELY or they will be Stolen forever. What a stab in the back by 500px. They know the reputation of the Chinese yet they went ahead with the deal anyway.

I worked for an MCI company who sold a satellite van to a Chinese electronics company. They were supposed to buy 12 but only ended up buying one and copying them. On the first day I arrived I gave them the software copies for their equipment. 5 days later they wanted me to help them debug it. When i looked it was installed on a different computer and was all in Chinese... they had copied the copyrighted software in 5 days and were already installing it on other equipment to resell!
