If you can just build an island and claimit, why hasn't the US built one there too? Then the Chinese would actually haveto seriously consider the repercussions of their interpretation of nauticallaw.

U.S. is wise to pick the island that islegally defined as "artificial island" per international law. Theisland is submerged at high tide before the reclamation. Such move giveseverybody a "face saving" solution - U.S. did what it promised toexercise "free nevigation" and China can cite the international lawas the reason for not taking action against the U.S. warship.
However, the consequence of the encounterwill be very much depending on how the U.S. action is communicated to, orperceived by, the Chinese. If it is deemed as "non-hostile", thenit's all good. Otherwise, it only gives the Chinese an excuse to arm the islandfor the purpose to "fend off" hostile activities that"could" endanger the residences on the island. Then, that is not good,for us.
