Smartphone giant Huawei Technologies Co. Ltd. won a patent lawsuit in China against global leader Samsung joining worldwide peers using legal means to protect their intellectual property.

Huawei’s filing of a lawsuit at home also reflects China’s status as the world’s largest smartphone market as well as Beijing’s efforts to nurture development of new technologies by building a strong intellectual property protection system.

华为在自家地盘上的诉讼文件不仅反映了中国作为世界最大手机市场的地位,也反映了北京方面为通过建立一个强大的知识产权保护体系来培育新技术产业而付出的努力。

A judge in Huawei’s hometown of Shenzhen on Thursday found that Samsung Electronics violated one of Huawei’s patents for wireless communication and ordered the South Korean company to immediately stop selling all products containing the technology according to a video of the trial posted online. It told Samsung to pay a small court fee but did not order any other damages.

根据网上发布的审判视频,一个来自华为家乡深圳的法官于周四判决三星电子侵犯了华为在无线通讯方面的一项专利,并要求这家韩国公司立即停止使用销售所有包含这项技术的产品。判决要求三星支付小额的法院诉讼费用,但没有要求其他赔偿。

Samsung said it would carefully study the decision and make an appropriate response in accordance with the relevant laws.

Huawei sued Samsung in both Shenzhen and California in 2016 for infringing on several patents. But the Shenzhen court determined that only one of those had been violated and dismissed claims involving the others. The California case has yet to be decided.

Huawei later extended its legal action to courts in Beijing and Quanzhou of East China’s Fujian province. The Quanzhou Intermediate People’s Court ruled in favor of Huawei last year and found Samsung liable for more than 80 million yuan ($12.3 million) in damages.

后来华为又在北京和泉州——位于中国东部省份福建,进一步扩大其维权行动。泉州中级人民法院去年判决华为胜诉,并认定三星对8000万元人民币(1230万美元)的损害负有赔偿责任。

Huawei is just one of a growing number of major companies turning to the Chinese court system to settle its intellectual property claims as Beijing tries to create a better environment for local innovation in its move away from low-end manufacturing. U.S. smartphone giant Apple Inc. and leading smartphone chip maker Qualcomm Inc. both sued each other in China last year over intellectual property theft as part of a series of lawsuits filed globally.

The decision to file cases in China is also a nod to the country’s status as the world’s biggest smartphone market accounting for nearly a third of global sales based on units shipped. Huawei is the largest player in its home market and the third-largest smartphone seller globally behind Samsung and Apple according to data tracking firm IDC.

Though I was reading on some other articles I came across this little tidbit:

Back in 2016 Huawei filed several patent infringement lawsuits in the US and China and alleged that Samsung used its cellular technology and software patents without licenses. Even though it was believed that Huawei wanted compensation for Samsung’s alleged unlicensed use the BBC reported that Huawei instead wanted an agreement to use Samsung’s technology.

早在2016年,华为在美国和中国多次提起专利侵权诉讼,声称三星在没有专利许可证的情况下使用其蜂窝技术和软件。尽管有人认为华为要三星为所谓的未经许可使用而做出赔偿,但BBC(英国广播公司)却报道说,华为(不要赔偿)反而是希望达成一项协议来使用三星的技术。

Kind of funny that if it was huawei's technology why would they want to use samsungs technology for themselves? They should technically already have it right?

korean courts routinely give samsung victories in these types of lawsuits as well. at this point home court (heh heh) advantage is really all that matters.

I remember reading something interesting about Samsung and Apple but I can't dig it up now. The former is basically a major patent holder and gives no fucks about other companies' IP. When Apple approached them with a lawsuit rather than addressing merit they just fired back "well look you're (possibly unwittingly) infringing X number of patents that we hold so we can go to war if you want."
As for Huawei and the whole China-Korea thing I don't know shit about this case but thought that was interesting :)

我记得自己有读过一些关于三星和苹果的有趣东西,但我现在找不到是在哪看到的了。前者基本上就是一个主要专利持有人,对其他公司的知识产权一点儿也不在意。当苹果起诉他们时,他们都没装模作样先礼一番,直接开火回敬了一句:“听着,可能是你(无意中)侵犯了我们持有的某项专利,所以如果你想的话,我们可以法院上见。”
至于华为和整个是中国还是韩国专利的案件,我任何情况都不了解,但我觉得这很有意思:)
