Hong Shing Chinese Restaurant was ordered to pay $10,000 to customer Emile Wickham after asking him and his friends to pay for their meals in advance. Ontario's human rights tribunal found that the restaurant racially profiled Wickham and his friends, all of whom are black.

TORONTO — Ontario's human rights tribunal has ordered a downtown Toronto restaurant to pay $10,000 to a black man for violating his rights after the establishment asked him and three friends to pre-pay for their meal.

The tribunal heard Emile Wickham, who identifies himself as an Afro-Caribbean, went to the Chinese restaurant with three friends — all of whom were black — early on May 3, 2014, to celebrate his birthday.

Wickham told the tribunal that after the server took their orders, he and his friends were told that a restaurant policy meant they had to pay for their meals before receiving them, which they did.

In its ruling, the tribunal said the restaurant did not offer a credible non-discriminatory reason for its employees' conduct and found Wickham had been racially profiled.

The Hong Shing Chinese Restaurant was ordered to pay Wickham $10,000 as compensation for infringing his rights and for the injury to his dignity, feelings and self-respect.

"This case illustrates that the restaurant did not extend the applicant the benefit of the doubt, or assumption of his decency as a black person, rather he was presumed to be deviant,'' the tribunal's ruling stated.

From Wickham's evidence, the tribunal said it was evident that the incident had a profound impact on him.

The restaurant's owner said the tribunal decision is under appeal, noting that the incident occurred four years ago when the restaurant was under different management.

This happened in my little home town.  We saw it happen, asked the waitress why with no logical explanation, so we've never been back to that establishment.  I was disgusted that our area depends so much on seasonal foreign farm labour and then discriminates like that when we have actually no reason to.  I let the owner know we would not be back and why.  They then can choose if they want to gamble with their livelihood.

This is not surprising . Toronto is hailed as a diverse city when it is in fact a segregated city  with various ethnic group spread out and separated amongst its suburb and core. Everyone for the most part sticks to their own and outsiders are treated with scepticism and prejudice. If you haven’t yet noticed this, then you’re white.

Human rights courts, as opposed to small claims and or criminal courts require little proof and often little chance of hearing equally both sides of a story. 
They exist to allow those with hurt feelings, tales of woe and others who do not have any evidence to still make claims and they should be eliminated.
Your human rights as they say are well protected within existing law and do not need an entire seperate body making up rules as they go to do it.

I hope that people continue to challenge racist behaviour. We are supposed to live in an mosiac country and this type of racist behaviour does not fit in. We should all thank people who challenge these discriminatory actions because one day that racist behaviour might directly impact you or someone close to you. Even if an individual doesn't personally  identify with the particular community that is having the issue, it should still be an issue that everyone fights for because we are all human beings.

Um, the restaurant would not have been fined if they required all customers to prepay.  Its treating one differently than the other that is the problem -- especially when the only data the restauranter had was appearance of race.

Okay, so I am not supporting what happened on May 3rd, 2014. But if the restaurant has a different owner and management now, then all it needs is support and sympathy. They are paying for somebody else's sins.  People often forget that there maybe some good people working on that establishment currently, and they also have bills to pay. Hating them for something that neither them or their management did is absolutely ridiculous. Instead I think the Tribunal should have fined the previous owner and management.
