A video showing a man on a motorcycle kicking down apedestrian on a busy road in Nanjing, east China's Jiangsu province, recentlywent viral.

近日流传的一个视频显示,在中国东部城市江苏省南京市的一条繁忙的道路上,一个骑摩托车的男子踹倒了一个行人。

In the video, a couple was crossing a street withheavy traffic, when a man riding a scooter passed behind the couple at a highspeed and suddenly kicked the woman from behind. The woman fell down to theground. The perpetrator sped away without a word.

在视频中,一对夫妇正穿过一条严重拥堵的街道时,一名男子骑着一辆小轮摩托车快速从这对夫妇后面经过,突然从后面踹倒了那名女子。女子当即倒地。作案者一语不发飞驰而去。

According to local police, the perpetrator, a32-year-old Polish student studying in a Nanjing university, has been detained.The man was punished with administrative detention for three days.
It can be seen from the video that this road's outerlanes were full of parked cars. Only two lanes in the middle were available fortraffic. The couple did not use the crosswalk.

当地警方说,作案者是在南京一所大学留学的波兰留学生,32岁,已被拘留。该男子被处以行政拘留三天。从视频中以看出,这条路外车道满是停放的汽车。只有中间两条车道可以通车。那对夫妇没有走人行横道。

A lot of netizens condemned the behavior of thekicking man saying that even the woman didn't use the crosswalk, she should bepunished by the police. The man's behavior had put the woman into a verydangerous situation.

很多市民谴责那名男子踹人的行为,认为即使那女子没有走人行横道,她也是该由警察处罚。那名男子的行为将那女子置于非常危险的境地。

A reporter from Beijing Youth Daily contacted thevictim, Ms. Xu, who said that the incident happened in the morning after sheand her husband dropped their child off at school. The road was full of otherparents’ parked cars. After Ms. Xu was kicked down to the ground, her knees andhands were bleeding.

北京青年日报的一名记者联系到了受害人徐女士,徐女士说事故发生在早上她和丈夫送孩子上学之后。那条路停满了其他家长的车。徐女士被踹倒在地后,她的膝盖和手掌鲜血直流。

Firstly, I cannot see why anyone would condone theaction of the motorcyclist; and secondly, in any civilized society with anydecent laws regarding violence, this guy would have received far harsherpunishment.  7

Good point. However, the video only shows the momentthe woman is kicked to the ground, and does not include footage of themotorcyclists approach. The woman may have ran in front of the bike causing therider to take evasive action. We have not been given the full story.

There is no reason for the motorcyclist to kick thepedestrian as he was not hampered by the pedestrian's action (though it isbetter for the pedestrian to use the crosswalk). The perpetrator should bestripped of his driver's license so he can experience being a pedestrian.   6

Hell, anywhere else, even in tinpot Somalia he wouldhave been jailed for felony assault, then deported. Ms. Xu should take him tocourt and make him pay if Nanjing is afraid to punished him severely.

I have forgotten how many times cars, motorcycles,bicycles, and people have challenged the laws of physics and suddenly stepped,or drove, in front of me, or behind me while I was backing up. I agree with Zhu, but I would also like to see somefairly simple road-rules enforced: no parking in the street, no vehicle[whether 2, 3, 4, more than 4 wheeled] disregarding traffic-lights, doubleyellow-lines, driving without lights, driving on the wrong side of the road,walking in the middle of the road, etc.  3

If DrObserver does not like what he sees on China'sroads, he should go back to where he comes from and refrain from making racistscomments, as if those situations he described are exclusive to China. Forinstance, more people are killed on American roads on a per capita basis thanin China.

This is a criminal act of assault and battery with intentsto cause grievous bodily harm, in addition of traffic endangerment andviolation. He should be charge to the fullest extent of the law. AsPolish national/citizen should notify the Polish Embassy to possibledeportation. He brings shame to his country and nationality. Of course, he isacting on his own. The Polish Embassy should be notified before he could domore harm to China and Poland?! The three days administrative detention is waytoo light and not reflective of the law and crime that person committed. Thisis a mockery of Chinese system of law and deterrent. Hope the Polish Embassyshould look into its own citizen behavior.

As a retired California appellate prosecutor, I thinkthe crime committed here (under California law) is battery. I see no evidenceof intent to cause grievous bodily harm, and there is no injury beyondscratches and bruises (not "serious bodily injury" under Calif. law).Hence, the maximum penalty would be one year in county jail and/or a fine of$2,000. But it is most doubtful that a first offender, presumably repentant,would ever be given such a sentence by a judge when no considerable injuryoccurred. It is much more likely that he would be given probation, have to paya sizeable fine, and given credit for time served in jail before hisrelease on probation, say 3 days. In other words, this case workedout about like I think would occur here.
But, who knows, the publicity and the prosecutor mightpersuade the judge that the case was flagrant and deserved an exemplarypunishment.

Not using the crosswalk was a mistake. It is dangerouspractice. Still, the motorcycle rider head no reason to kick anyone. It shouldalso be punished. Not matter who is he is: white or otherwise. China shoild notallow foreigners to act this way. One hundred years of humiliation underwesterners should be over.
