FORMER Foreign Secretary Albert del Rosario on Friday said President-elect Rodrigo Duterte had given  assurance that there would be no bilateral talks with China to resolve the territorial dispute in the South China Sea in the next two years.

Supreme Court Associate Justice Antonio Carpio also said the Philippine panel in the arbitration proceedings against China had received the same assurance from Duterte.

Del Rosario led the Philippine panel that argued the country’s case against China in the United Nations Permanent Court of Arbitration in The Hague.

Carpio who has done an extensive study on the territorial dispute between China and the Philippines in the South China Sea was an observer in the proceedings.

The Philippines has asked the UN tribunal to invalidate China’s claim to almost all of the 3.5-million-square-kilometer South China Sea and demanded its right to exploit resources in waters within its 370-km exclusive economic zone recognized under the United Nations Convention on the Law of the Sea be respected.

China has refused to take part in the proceedings saying it will not abide by any ruling of the court.

what carpio has not told you is that china has rectified unclos upon signing and it enjoys specific unclos rights to ignore the philippines itlos fiasco. :)
carpio has also not told you that unlcos has no authorization to determine island sovereignty and the philippines has not followed unclos procedures by negotiating with china and china has never agreed on an arbitration in the first place. :)
carpio also lacks the courage to bring his case to beijing directly hehe....

When the UN Court ruled that it has jurisdiction over PH's case in October last year it stated that the decision it makes on the case will be binding for both parties to the dispute namely PH and China being ratifying members of UNCLOS. Therefore the court didn't find any exclusion or exemption for China arising from any conditions China expressed during China's ratification of UNCLOS in the mid 90's.
In addition Article 317 of UNCLOS states in summary that UNCLOS members after joining the convention treaty may renounce UNCLOS later. but such action will not exempt China or any other member from any rules or laws it committed when China or any other member signed and ratified the treaty.

去年10月份联合国法庭认为自己对菲律宾所提出的案件具有司法权，该法庭称其判决对双方即作为《联合国海洋法公约》的成员国的菲律宾和中国都具有约束力。因此，法庭认为中国在90年代中期加入《联合国海洋法公约》时所提出的条件并不能赋予中国任何的豁免权。

binding? based on which article in unclos? not even the u.s. and australia have accepted similar judgement upon them as "binding". :)  and based on unclos china has refused arbitration meaning that the philippines has violated unclos procedures in the first place. :) and you simply keep failing to mention china's unclos rights to ignore the philippine fiasco too hehe....

China can continue to ignore UNCLOS and/or ignore the decision of the UN court expected in a matter of weeks. But all it's actions after the announcement of the UN court decision in JULY 7 2016 or so on a very important world issue will reflect on China's reputation and standing in the world community.

Its is a wise move by the Philippines to defer any "bilateral talks" with China a sure bacterial disease they carry in their brains far too long.The results when the present arbitration is released will provide a game change.And the legal claims to use the " seizure' assets in Canada when gas and other minerals are extracted is a good way to solve China's greedy venture into sovereign territorial grounds as owned by the Filipino people.
